SYLACAUGA — The Alabama Department of Environmental Management denied requests for a public hearing from residents in and around Sylacauga and has begun enforcement of the $72,000 civil penalty imposed on REEF Environmental Services as agreed upon in a consent order between the two entities, but numerous Sylacauga citizens have appealed the decision.
Sylacauga resident Clara Curtis was notified by ADEM earlier in November that the agency had decided not to hold a public hearing concerning the consent order between REEF and ADEM, which established the $72,000 fine. Curtis had sent in either letters or petition signatures of approximately 2,000 people, she said.
Curtis said ADEM responded that comments from only four citizens had specifically asked for a public hearing and only one other commenter raised an issue specifically related to the consent order – the clause that REEF would pay the fine through installments over three years.
A memorandum between ADEM Air Division employees Scott Sanders and Wes Thornhill published on the ADEM Web site stated Sanders explained to Curtis over the telephone that the petition was not directly related to matters listed in the consent order, which was the failure to properly install and operate a scrubber and basin cover at REEF.
Since the petition was not related to the consent order, the approximately 1,800 signatures were not considered. The submitted comments that did not directly relate to the consent order were also not considered when determining if any changes should be made to the consent order, the memorandum stated.
Curtis is appealing the decision. “(Monday), I just sent 44 more letters by certified mail. They state we object to the consent order, and we still request a public hearing to be held in Sylacauga,” Curtis said.
An off-and-on odor from the REEF facility on Twin Street in the Mill Village just outside Sylacauga has been a nuisance to citizens living within a radius of several miles of the facility since the spring of this year. REEF is a wastewater collection and treatment facility.
On Sept. 29, ADEM found REEF in violation of an air permit ADEM had issued to the company on May 15 of this year. The violations consisted of the failure to properly install and maintain a basin cover on the facility’s equalization basin 1, failure to install a scrubbing system, and failure to route emissions to the scrubbing system.
As part of the agreement, REEF still denies many of ADEM’s claims but has agreed to pay the $72,000 by paying 36 monthly installments of $2,000.
Citizens had a month to submit written comments and/or request a public hearing.

A waste treatment plant right outside of our town is polluting the air so bad it's almost not breathable. The stench is horrible and it makes your eyes water. Our local paper is doing it's best but, the city won't do anything (their excuse is that it's outside the city limits), the county has basically done nothing, one of the Birminham news stations covered it and nothing became of it, the state fined them $72,000 but gave them 3 years to pay it! The Alabama Department of Environmental Management (ADEM) recently denied a citizen's request for a public hearing!
There is a court hearing for March but, by then, there are going to be a lot of sick folks!

We did pull the comments after the mayor called an confirmed it was not him. We normally would give some sort of notice under the posts if we think pulling them would cause confusion.
In this case, the person posting, by falsely claiming to be someone else and behaving in such a defamatory way, placed us in a position where we had to remove their account. Actually, that person had created several identities using different email accounts, and all of those have been blocked from the site.
As a result, most of his comments were also pulled down at the same time in too many places for us to send out notifications for each one.
Sorry about any confusion it has caused.

I drove through town last night and the smell was really bad. Someone bring me up to speed, what is the problem (i.e., what is REEF?) and why can't (won't?) the local government deal with it?
How long has this been going on? It seems this local paper has been doing a good job reporting it but what do the TV stations in Birmingham had to say about it?
I read that the state fined this company some small amount ($72K I believe); seems like they may have been influenced by someone else.
This lady Clara seems to be on the right track; wouldn't large road-blocks, etc, help?
It seems like there are some really aggravated people on the forums; why won't the rest of the community get involved? From what I smelled, seems like the whole town is affected.

concernedc12, I think the complaining is about the possiblitiy of people that are getting sick being related and the possibility of people that are not sick yet (you and your neighbors) having any health issues in the future. REEF was found to be in operational violation by ADEM. Maybe it's not as much about the smell as them willfully operating without the proper equipment to minimize your health risks. It's not the smell, it's what's floating around inside the smell that might get you.
The city officials feel "safe".....but, watch out, Mr. Mayor, when you put yourself on a pedestal, above the the citizens you are supposed to "serve", you're very likely to be blind sighted and take a fall. The people this is affecting, may be in a bad situation, but they're not stupid and action is starting to take a form....rumbles of things to come have started. Can you hear them way up there?

I am not very informed on what is happening there and if there are any health risks. Can you help me understand? My wife and I drove through that area over the weekend and it smelled really bad. My wife is pregnant (with our first)and I don't want to introduce her to a health risk if I can avoid it. I am sure everyone else would like to know, also. Is there something we need to know?
Civilized....you hit them where it hurts....bring them into the situation, whether they "care" or not.
Soon your problems will be THEIR problems....in a big way.
Mr. Barton says we need "sensationalism" to get the media worked up.
Sensationalism can be achieved without physical altercation or anyone getting hurt. (unless you count the wallets of "paid" officials.)
What are these politicians in fear of? I'd say they don't want their names and their uncaring attitudes splashed across any form of media or their "maybe" ties with ADEM/REEF..."turning their heads" as people are getting sick/sicker is involvement with REEF, in my book.
Miss Clara...you have the list of all the people you sent your info packet to...this would seem like a good place to start...the people you contacted and heard nothing from should be brought to the attention of the general public.
Crashing a city meeting or a "sit in" are both good ways to get the problem into the homes of people who have no idea what's going on.
Anything that takes place needs to be planned carefully. No "half baked" demonstrations or rebel rousers.
A marching band might help. :-)
I'm not talking about involving our youth, but aren't there some of you with musical talent?
MARCHING to a sit in or public meeting, with "background music" would surely get attention. BUT, we need those TV cameras rolling.
Any of you have skills in making signs?....if Mr. Barton wouldn't mind, we could borrow "In the Interest of the People" for the signs, adding...REEF/ADEM bullets....People are SICK of the Stink....etc.
Most of you can come up with "catchy phrase".
There would have to be an organizational meeting....this would be Step #1. We need a leader.
Start thinking about WHO would be best for this. There are few people we all look toward for the "truth", and fewer still who will act on it.
The majority of people who this mess is affecting most, don't have the resources to fight alone...they are also sick and they have no way to leave Sylacauga and "start over". They are stuck and don't know where to turn.
You know, the air that affects Sylacauga is only 20 miles from Talladega....weather can do strange things....

Has anyone crashed a city meeting? What if we could get some media involved to crash the meeting and put some people on the spot while they were all together? That might be better than individual interviews and phone calls. If even 1/4 of the people that signed that petition showed up together, that would be impressive. I really don't think everyone that signed will stand together, but you never know.
That's a bit overboard; HOWEVER--
Remember the '70's? How about hundreds of people having a sit-in, complete with gas masks, handkerchiefs across noses, and everyone waving barf bags and bottles of calamine lotion? Show blown-up pictures of children during asthma attacks and people with nosebleeds--all the symptoms that the Bog of Unending Stench is causing? The News Media would have a field day with that image!!
Keep the good, do-able ideas coming!
Larry Barton, Channel 47, and the Daily Home are doing an admirable job with REEF, but more coverage is needed.
All three channels I have given links to, had my story with pictures, video, etc.
This REEF situation is about human beings and life and death....about a town slowly being poisioned.....it should be a high profile, front page, prime time media event. Where are the cameras now.
Do stories about animals sell more papers and challenge media coverage/time more than the death of a town?
If this gets on television, I imagine some of the officils connected to Sylacauga will be squirming in their seats to get it OFF the air. Maybe they should start with an interview with the mayor?
