Fred Benjamin, 48, of Talladega, was convicted of sexual abuse in the second degree in 1999. The victim in that case was a 13-year-old girl.
According to the state Department of Public Safety’s web site, Benjamin’s address on Red Lane was last confirmed in January 2012. According to Talladega County Sheriff’s Investigator Barry Kimsey, Benjamin was arrested for failure to his renew his registration at least every quarter.
“It’s the same thing as not registering at all,” he said. “It’s still a Class C felony.”
Kimsey said because sexual abuse in the second degree is a misdemeanor, Benjamin had not gone to prison on that particular charge. He had been sent to the penitentiary on non-sexual charges, however, and was released in 2009, according to DPS.
Kimsey said he had investigated the original sex abuse allegation in the late 1990s when he was working for the Talladega Police Department.
Benjamin is unemployed and does not appear to own a vehicle, according to the site.
Conviction of a Class C felony carries a penalty of one year and one day to 10 years in prison.
