TALLADEGA — An Anniston man has waived extradition from Georgia to Alabama in connection with a fatal shooting in Talladega Friday night or Saturday morning.

According to Talladega Police Chief Alan Watson, officers initially responded to a call reporting a man lying in the road near the dead end of Whitson Road, near the railroad tracks. Upon arrival, about 8:30 a.m. Saturday, officers discovered David Scott Hubbard, 26, of Munford, who appeared to have been shot once in the head. Hubbard was still breathing when the officers discovered him, and was airlifted to University Hospital in Birmingham by LifeSaver helicopter. He was pronounced dead at 5:43 Saturday afternoon.

The subsequent investigation led officers to Villa Rica, Ga. There, local officials arrested John Ellis Chastain, 40, on the Talladega murder warrant. Watson would not elaborate on how Chastain was tracked to Georgia.

He said Chastain waived extradition Monday afternoon and could be back in Alabama as early as today.

Watson said Chastain’s permanent address was unclear Monday. He had lived in Anniston at some point, and had ties to Talladega, he said.

It was also not immediately clear what time Hubbard was shot. When police arrived at 8:30 Saturday morning, Watson said, “it appeared he had been laying there for some time.”

Although the investigation remains ongoing, Watson said he was not aware of any aggravating circumstances that would make this a capital case.

Hubbard appears to have been shot with a handgun, according to the incident and offense report.

Murder is a Class A felony, punishable upon conviction, in this case, by 20 to 99 years or life in prison.
