ADEM requires REEF to pay $72,000 penalty

SYLACAUGA — REEF Environmental Services and the Alabama Department of Environmental Services have agreed to a proposed consent order for the company to pay a civil penalty of $72,000 to ADEM.

ADEM found REEF in violation of an air permit ADEM issued to the company on May 15 of this year. The violations consisted of the failure to properly install and maintain a basin cover on the facility’s equalization basin 1, failure to install a scrubbing system, and failure to route emissions to the scrubbing system.

As part of the agreement, REEF still denies many of ADEM’s claims but has agreed to pay the $72,000 by paying 36 monthly installments of $2,000 when the consent order goes into effect.

Final approval of the consent order cannot happen until after the public has had 30 days in which to comment on the order. ADEM released the notice on Sept. 29, so any member of the public can submit a written comment, including a request for a hearing, to ADEM until Oct. 28.

Comments should be sent to the mailing address – Alabama Department of Environmental Management, Attention: Ronald W. Gore, chief of the Air Division, P.O. Box 301463, Montgomery, AL 36130-1463.

The link to the full copy of the consent order is highlighted on the public notice page and is in PDF form. Those without Internet access can obtain the consent order for a nominal fee by sending a written request to the previously-mentioned mailing address.

According to the consent order, when ADEM issued the air permit on May 15, it set a deadline of June 30 for REEF to have the basin cover and scrubber system installed on equalization basin 1 for odor control.

ADEM then performed an unannounced inspection of REEF on July 1, and found an approximate 100-foot tear in the basin cover and the scrubber system was not fully installed.

REEF’s rebuttal in the proposed consent order states REEF believes the basin cover delivered to the company was not appropriate for the type of treatment being performed and/or has a manufacturing defect. REEF claims it has vigorously pursued getting the basin cover replaced or repaired by the manufacturer.

REEF also claims a thunderstorm blew down the partially-installed scrubber which led to a delay as the scrubber was refabricated. The scrubber has been operational since July 13, REEF claims. The company plans to continue to use the scrubber even with the cover being deflated with the tear because it still seems to reduce the odor.

REEF also points out there is no reliable scientific evidence that the facility’s emissions cause any injury to the environment or to people. The company says ADEM’s own air monitoring at the site, as well as surrounding areas, revealed no significant levels of hazardous air pollutants coming from the REEF facility.

Several residents in the Sylacauga area have reported in the media and at public meetings that the odor has affected their health.

Should the consent order agreement between the two parties breakdown, the matter would be handled in Montgomery County Circuit Court.

TO: Furious...You suggested an excellent idea...block the roads and stop these trucks from coming in to drop their cargo....whatever it is....The mayor says the city does not have any authority to do anything...so if this is so, the police cannot arrest you for blocking the road...I guess it would take Sheriff Studdars deputies to take care of this...just maybe the deputies would be up in Munford would take a long time to get to Sylacauga...I don't encourage anyone to block roads,,,,the drivers might just run over you, but taking pictures of the trucks and getting tag numbers would be something that they may become concerned about...especially if they are hauling something illegal...thanks for being involved...

My grandson's and myself are haveing more and more symptoms turn up every day.My asthmatic grandson is haveing more complication's daily.My grandson's arehaveing headaches,naseau,lung problem's,and other strange illnesses turning up every day.I don't know if it is all to do with the posionous reef plant or if someone else is doing things too.But i know most of it is from the reef plant.The rest is from other sources.Don't you police and counsel and mayor,etc.know that when that stinch is set off that it is giveing the meth cookers the golden oppertunity to cook their meth while the stinch is covering up their odors of meth labs cooking ,which is also killing innocent people.IF YOU ALL HERE IN SYLACAUGA CAN'T HANDLE THE PROBLEM,FOR GOD AND THE PEOPLE OF SYLACAUGA'S SAKE,CALL IN SOMEONE WHO CAN SOLVE BOTH PROBLEM'S.FORGET THE MONEY YOU MUST BE RECEIVEING,THINK AND CARE ABOUT THE PEOPLE.YOU CAN'T TAKE IT WITH YOU WHEN YOU GO.AND THE GOOD LORD WILL MAKE YOU PAY IN THE END.THAT IS A GOD GIVEN PROMISE///////IF YOU DON'T BELIEVE IT JUST WAIT AND SEE.

I SAY THE PEOPLE OF SYLACAUGA SHOULD FORM A ROADBLOCK AND STOP THOSE TRUCK'S THAT ARE HAULING IN THAT POISON THAT'S KILLING ALL OF US.THEN WHEN WE GET ARRESTED FOR DOING THAT;SUE THE HECK OUT OF SYLACAUGA AND REEF BECAUSE THEY DON'T CARE THAT IT IS KILLING OUR CHILDREN AND OTHER LOVED ONE'S,ALL THEY WANT IS THEMSELVES AND THEIR FAMILIES TO BE WELL CARED FOR.IT'S TIME TO TAKE A STAND.

Thanks Larry. I hope there's a large turnout at the meeting tomorrow. I'm busy trying to raise money for the school system; hopefully you won't face the same apathy at this meeting re REEF as I am in trying to get folks to open their wallets.

larry barton is the meeting at the chamber of commerce or the city building of sylacauga.i know its at 9:00 a.m.wedensday.i'm new to this kind of local activism and don't exactly know where to go,but feel strongly about this issue about reef and i want to do my part to end reef.

THANKS TO ALL WHO ARE BECOMING INVOLVED...THIS IS WHAT IT WILL TAKE TO GET ACTION... TO KEEP DIGGING;...You are right on target...trace the money. all city officials, the campaign forms are filed with the Talladega County Probate Judge and anyone can visit the office and ask to review the records....this is free. You can also obtain a copy of all records...the only problem, if cash money has been given, and the politician did not list it...you are out luck...the other state officials records can be accessed on the computer from the Sec of State web site...very easy and accessible....something stinks in Sylacauga and I am not sure it is just REEF....Once again, thanks for becoming involved...DON'T FORGET THE MEETING AT SYLACAUGA CITY HALL WEDNESDAY MORNING...I UNDERSTAND THERE WILL BE A LARGE TURNOUT AND OUT OF TOWN T.V. MEDIA HAS BEEN INVITED ALONG WITH ALL THE OTHER MEDIA...CALL CITY HALL AND GET THE TIME OF THE MEETING...THE ELECTED OFFICIALS OF SYLACAUGA AND THE COUNTY CANNOT STAND THIS TYPE PUBLICITY...THEY WILL BE FORCED TO TAKE APPROPRIATE ACTION. $72,000 is a drop in the bucket compared to the damage this stinch has already caused. Many folks live in Sylacauga to escape the smell of the papermill because I AM ONE OF THEM. The papermill never caused me to get physically ill like this stinch. The papermill corporations use to just budget the small fines they received from ADEM rather than obey their orders. Sounds like Reef owners doing the same. This shows me They could care less about the people in Sylacauga. People this is our opportunity to

get rid of Reef. We all must write or e-mail ADEM and object to the concent agreement. We don't want a fine we want Reef shut down. It is dangerous to our health. How many time did they say that asbestos or nuclear waste would not or did not cause human sickness. How many people have died and suffered from these things? Countless thousands if not millions. I hate to think that I retired, moved from Childersburg to beautiful Sylacauga to escape the stinch and can't enjoy or even allow a stinch to kill me before my time. These people from Reef did not submit trueful and acurate information in order to get a permit to operate this facility so close to such a populated area. Remember write or call or e-mail or visit ADEM and let them know this situation is intolerable. City officials please annex this area now and purchase anything else that could be sold by Avondale. Remember people of Sylacauga the Avondale that shut down was not the Avondale you could rely on back when. Why do we have to continue to talk about this stinch. Crazy Crazy Crazy.

Now that we have names, it will be fun to go check the public campaign records from the most recent races for:

1. Mayor of Sylacauga; Sam Wright

2. Each council-member of Sylacauga; Walter Jacobson; Doug Murphree; Ken Horn; Jim Heigel; Manuel Smith

3. State Representative of our district; Ron Johnson

4. State Senator for our district; Jim Preuitt

5. Each US Senator for Alabama; Jeff Sessions; Richard Shelby

6. US House of Rep.; Mike Rogers

Not only the winners, but check the people they were campaigning against, lobbyist do not care about party lines, they just care that whomever won got monies from them so they can say "I helped get ya in office ole buddy ole pal". Check each person out, their campaign contributors are public record for anyone to see. Who wants to bet that one or more of these names will appear on contribution lists? Kenton Hall; David Dagford; William Mershon; Vernon Taylor. But you know politics can be tricky, they may have contributed under another name, that of a spouse, god only knows all those tricks - so you may or may not find a "gotcha" moment, but bet your bottom dollars that people received monies for their campaigns from these folks. Maybe some returned the checks, kudos for those that did, for those that accepted the funds, shame on you and I wish you had to spend every night of the rest of your term sleeping on a sleeping bag right slap dab in the middle of the air path of REEF, LLC - that would be a small step in repaying the public for your betrayal.

TO: BG SCHNEIDER...I do not have any info on the owners of REEF...I only know that they live in Prattville. The Mayor and Calvin Miller or the Industrial Board should have all this info on file...they are the ones who helped bring them to the city.

To: STEVE TERRELL...You may be right about the powers that be not caring about the mill village citizens....I do and t.v. 47 does...our film crew spent several hours there this afternoon...almost choking to death due to the fumes, and if all goes as planned, I will be showing the interviews of several citizens who live in the mill village. I do know that the semll is beginning to penetrate the "society" section of town and they are beginning to speak up and make phone calls...this is what it is going to take...everyone sending a message to their elected officials that they are upset, mad, and yes sick...does not matter where you received your education...in prison or any school system....everyone is being affected by this odor...Thanks for speaking out.

What can we do to make these people stop the reef plant/If we lose loved one's from this stinch we can't bring them back.It's bad enough that we are faceing the swine flu crisis why do we have to live in fear of health problem'from the reef plant too/.someone has to make a move to stop it soon;tonight would'nt even be soon enough.lot's of damage has already has already been done to our health.please shut down this reef plant quickly.please///////////////.

The smell is terrible again. I believe the poisons are "eating" the tarp away. Reef is not going to say that the stuff is poisoness. They are making lots of money off of it and the owners do not live here. They are killing us and no one cares.

Darn for $72.00 I could have sprayed three cases of Fabreeze and got rid of the odor for alittle while. What is fining them this money going to do, the odor is still present. Give me a brake this is nothing but a slap on the palm of their hand. To the mayor and city council I have one comment "YOU SUCK", I put that in words that you can understand. This has went on long enough, the city is becoming the fart capital of the south. Try biting into a number three combo at Wendy's and all you smell is the back side of the cows butt. If my house smelt like this all the time then the health department would come in and condemn the place. One thing is for sure my property taxes should be cheaper this year because it can't be worth what it was before the smell rolled in. As a kid in Childersburg you could smell the paper mill and people said that is the smell of money that people was making, I guess in Sylacauga this is the smell of money being lost because who in their right mind passes through Sylacauga wants to stop and eat with this smell. Hey Sam maybe this is not coming from the plant maybe it is just the smell of crap that you have been shoveling this city since becoming mayor. This is my opinion and I really don't care who likes it, it is time to wake up and take this city, county and country back because in the direction it is going the whole nation is going to smell like this before long. Vote em out. WAKE UP AMERICA WHILE YOU STILL CAN!!!!!!!!!

Why is ADEM being rewarded with money because of infliction of pain and suffering to the folks in Sylacauga? ADEM is a government agency and giving them money is not going to fix anything. Seems to me that all Sylacauga is any good at is en"forcing code or en"forcing" traffic laws but when it comes to people suffering in it's own community then that is put on the back burner. Adolf Hitler would be proud. If people do not pay their traffic fines or code enforcement fines then they will go to jail as punishment, then why is it there is no punishment for the hierarchy in Sylacauga when they offend??? Obviously there are two sets of standards as far as the so called law goes: one for the common folks and one for the click. I am glad I live no where near Silly Cauga.

The seriousness of REEF and the damage it is doing

to the people in and around Sylagauga should be reason enough not to put inane slurs on this board.

Obviously, you have not experienced the smell and certainly not the illness it has brought and is bringing to the people, including our older citizens and newborns.

Education is education no matter where it comes from....something you seem to lack entirely.

Face the facts, folks. The polictians do not give a damn about the people in the mill village or any of the surrounding areas where the smell is so bad. Do you think they go to bed at night smelling it? No, out of nose, out of mind. It appears, unfortunately, that we're going to have to wait until the next election and put some folks into office that care.
