King sets court date of May 5 for Reef lawsuit

SYLACAUGA — Talladega County Circuit Judge Julian King has set a status conference for May 5 for the suit being brought by two Walco residents against REEF Environmental.

Chris Hood, attorney for residents Sandi Boone and Sammy Rudd, said he had moved to consolidate this case with another civil suit being brought by the city of Talladega, but Circuit Judge Bo Hollingsworth ruled that the cases should proceed separately.

An amended version of the residents’ suit lays out five possible violations, such as allegations that the company “offends against any of the acts creating, altering or renewing such a corporation; violates the provisions of any law, by which such corporation forfeits its charter, by abuse of its powers; has done or omitted any acts which amounts to a surrender of its corporate rights, privileges or franchises or exercises a privilege not conferred by law.”

If King rules in favor of the plaintiffs and against REEF, he would issue a writ ordering the company to cease operations. Talladega County District Attorney Steve Giddens would be responsible for making sure the company shuts down.

Giddens said he had been notified of this and agreed to accept this responsibility if needed.

“That’s the remedy prescribed by state statute,” Hood said. “We are alleging that the Walco folks are taking the brunt.”

A separate lawsuit brought by the city of Sylacauga is scheduled for a hearing next month.

Both suits allege that foul smelling emissions from the wastewater treatment plant had negatively impacted the health and quality of life for area residents.

I have lived here all my life minus military obligations and i want yall to try to remember the days when a smile from a public servant meant something and you could tell when it was not clouded with ulterior motives such as getting your vote or your money.And if anything was brought into the community it was discussed with the public and the impact it would cause.Now due to greed and personal gain and numerous cover ups,Well we suffer.WHY ?all we ask as citizens is a voice again and that our public servants not hurt us anymore.If i did run for mayor my only payment i would want is to see the citizens smile again and not be afraid to speak and i promise you whatever it took we together could abolish these things that that have been put in place by the greedy godless powers that be.Has anything they have done benefitted you?no?then its time to be heard and it dont cost money.Iwould rather eat corn bread and beans and see the people smile than eat steak and watch this city die.SAM what are you and kent eating today?and have you asked some citizens how they feel today?I have and i reassured them that things will get better.JUST PRAY ITS NOT TOO LATE FOR SOME OF THESE KIDS.REMEMBER IT TOOK YEARS to find the true effects of monsanto and asbestos poisining.

I can throw my hat in the ring BG but in this county connection with dirty money gets votes.If we could get folks to vote their heart and not who has the prettiest 3 piece suit then we could do it .Also the folks that vote the good ol boy system has to realize that those days are over .

godspeed sandy and mr rudd i hope that this matter is finally going to come to and end before all the surrounding neighborhoods dry up or die .How inhumanly we have been treated without a thought of our health or welfare .It all started with a handshake from sam wright and kent hall.now i would love to see those hands in cuffs for what they did to my family and friends.If this was the old days im sure as some have said we would be looking for a tall tree.also political lives have been ruined for stances that were took by people we thought had common sense but it turned out the only thing that was in there eyes were dollar signs.people remember the ones who tried to stop reef even though most of them were common folk with no political agendas.Heck at this point i believe i could be mayor and do something we aint seen in years and thats care about the people and the hell with dirty money.Good jobs will come when we get rid of this political mafia.
